Spacy VPN Terms of Use

In short

  • Spacy VPN encrypts your connection and routes it through our servers. We work to keep the service running at all times, but we can't guarantee access to specific sites on every network.
  • A subscription extends your access for the period you paid for. There are no automatic charges: you pay for each period yourself.
  • The service may not be used for illegal activity, attacks, spam or reselling access.
  • A refund is possible if the service didn't work through our fault. We review every request individually.
  • By using the service, you accept these terms and the Privacy Policy.

1. General

1.1. These terms are an agreement between you and Spacy Network ("we"). The agreement covers the Spacy VPN apps for iOS and macOS, the spacy.site website and the service's Telegram bots (together, the "Service").

1.2. You accept these terms when you create an account, sign in to the Service or pay for a subscription. If you don't agree with the terms, don't use the Service.

1.3. Paying for a subscription on the website is also governed by the Public Offer. Where the offer and these terms conflict on payment matters, the offer prevails.

2. What the Service is

2.1. The Service creates an encrypted connection (VPN) between your device and our servers in various countries. It can:

  • choose a server automatically;
  • switch to another server if the current one stops working;
  • with split tunnelling on, send selected sites directly, outside the VPN.

2.2. Our obligation is to run the Service with reasonable care. We do not guarantee:

  • access to any particular site or service;
  • any particular speed;
  • operation on networks where VPNs are restricted or blocked by the provider, the network administrator or the authorities;
  • uninterrupted operation during maintenance or outages at our contractors.

2.3. The Service does not make you fully anonymous. Sites still see what you tell them yourself: accounts, cookies, browser data.

3. Account

3.1. You need an account to use the Service. You can sign in with Telegram, Apple, Google or email. You can link several sign-in methods to one account, but one sign-in method can belong to only one account.

3.2. You are responsible for access to your devices and sign-in methods. If you notice a sign-in that wasn't you, tap "This wasn't me" in the notification or write to support, and remove the unknown device in Profile.

3.3. A new device becomes trusted when another trusted device approves it, or on its own after 3 days. Until then it can't perform risky actions such as deleting the account or managing devices.

3.4. You may use the Service from the age of 14. If the law of your country requires parental consent, you confirm that you have it.

3.5. You can delete your account at any time: Profile → Delete account. Unused subscription time is not compensated after the account is deleted.

4. Subscription and payment

4.1. Access to the servers is provided for the period you pay for: 1, 3, 6 or 12 months. Current prices are shown on the website and in the Telegram bot.

4.2. Prices on the website are shown in US dollars for convenience. You are charged in roubles at the price shown on the payment page. Payments are taken by YooKassa. Your card details never reach us.

4.3. If your subscription is still active, the paid days are added to its end date. If it has ended, they count from the moment of payment.

4.4. There is no automatic renewal. We don't store card details and don't charge you without your action.

4.5. After payment we send an electronic receipt to the email given at payment. VAT is not charged.

4.6. A promo code gives a discount on one payment. Each code can be used once per account. Promo codes can't be exchanged for money.

4.7. Free trial: you get 1 day of free access when you sign up, and 2 more days for subscribing to the Spacy Telegram channel.

5. Refunds

5.1. Refunds are not automatic. We review every request individually.

5.2. To request a refund, write to support within 7 days of payment. Include:

  • the payment number;
  • what the problem is;
  • your device and OS version;
  • your country and internet provider;
  • how long the problem has been happening.

5.3. We will refund you in full or in part if the Service substantially failed to work through our fault and we couldn't fix it.

5.4. There is no refund if the cause is:

  • VPN blocking or restrictions by the provider, the network administrator or the authorities;
  • the settings, fault or incompatibility of your device;
  • a breach of these terms that led to your access being restricted.

5.5. Refunds are made by the same method used for payment, within the time frames set by YooKassa and the bank.

6. What you must not do

You may not use the Service to:

  • break the law or infringe the rights of others, or distribute prohibited material;
  • attack networks and services (DDoS, hacking, vulnerability scanning without permission) or spread malware;
  • send spam, or engage in phishing or fraud;
  • resell or pass on access to third parties;
  • get around the device limit;
  • create excessive load that interferes with other users;
  • interfere with the Service or try to access other people's accounts.

You alone are responsible for whether using a VPN is legal in your country and for how you use it.

7. Restricting access

7.1. We may suspend or end your access if you breach these terms, put the Service or other users at risk, or if the law requires it.

7.2. If the breach is not serious, we will warn you first and give you time to put it right.

8. Intellectual property

The apps, the website, and the Spacy VPN name and logo belong to us. You get a personal, non-exclusive right to use the Service for the duration of your subscription. You may not copy, modify or decompile the apps, except where the law expressly allows it.

9. Liability

9.1. The Service is provided "as is". To the extent permitted by law, we give no warranties beyond those stated in these terms.

9.2. We are not liable for:

  • indirect losses, lost profits or loss of data;
  • the actions of providers, networks and authorities, including blocking, traffic filtering and DPI;
  • the content of sites and services you open through the VPN.

9.3. Our total liability is limited to the amount you paid for the most recent paid period.

9.4. Nothing in these terms limits rights that the law of your country gives consumers and that can't be limited by contract.

10. Changes to the terms

We may change these terms. We will announce material changes in the app or on the website at least 7 days in advance. If you keep using the Service after the changes take effect, you accept them.

11. Governing law and disputes

11.1. These terms are governed by the law of the Russian Federation, unless the law of your country requires otherwise for consumers.

11.2. Write to us first: most issues are resolved by support. If we can't reach agreement, the dispute goes to the court determined by law.
